Boyden Gray & Associates filed an amicus brief in King v. Sebelius, in the Fourth Circuit, challenging the IRS rule allowing “premium assistance credits” for health plans purchased through federal Exchanges. The Affordable Care Act limits the credit to plans purchased through “an Exchange established by the State.”
This was the second amicus brief the firm has filed on behalf of the Galen Institute related to the rule. The first was filed in Halbig v.Sebelius, in the D.C. Circuit.
