Boyden Gray & Associates filed a brief this Monday on behalf of Aaron and Melissa Klein, the proprietors of Sweet Cakes by Melissa, in a case before the Oregon Court of Appeals that will address fundamental questions about the scope of state public accommodations laws, free speech, religious liberty, and due process before administrative tribunals. The Oregon Bureau of Labor and Industries fined the Kleins $135,000 after they declined to create a custom-designed cake for a wedding to celebrate the marriage of a gay couple. The Kleins, who do not dispute in this case the couple’s right to be married, declined to create a cake for their wedding because of their sincere religious belief that marriage is a sacred union between a man and a woman.
